Welcome to Gladley’s® Candy Kitchen. These Terms of Service (“Terms”) govern your use of www.gladleys.com and your purchase of products from Gladley’s Candy Kitchen.

Gladley’s Candy Kitchen (“Gladley’s,” “we,” “us,” or “our”) is operated by Gladley’s LLC, located at 356 Main Street, Laurel, Maryland 20707.

By visiting our website, placing an order, creating or using a customer account, subscribing to communications, or otherwise using our services, you agree to these Terms and our Privacy Policy.

1. Our Online Store

Gladley’s offers candy, confections, gifts, and related products through our online store.

We currently sell and ship products within the United States.

We reserve the right to modify our products, services, website, prices, product descriptions, packaging, quantities, and availability at any time without prior notice.

We may discontinue a product or limit quantities available for purchase at our discretion.

2. Eligibility and Appropriate Use

By using our website or placing an order, you represent that you are legally permitted to enter into the transaction or that you are using the website with the permission and supervision required under applicable law.

You may not use our website or products for any unlawful purpose or use our services in a manner that violates applicable laws or regulations.

You may not attempt to interfere with the security, operation, functionality, or integrity of our website or Shopify’s systems.

3. Product Information

We make reasonable efforts to describe and display our products accurately.

Because many Gladley’s products are food products and may be handmade, small variations in appearance, size, shape, color, decoration, weight, packaging, or presentation may occur.

Product photographs are intended to represent our products as accurately as reasonably possible. Actual colors and appearance may vary depending on lighting, photography, your device, display settings, and normal variations in food products.

We reserve the right to correct errors or inaccuracies in product descriptions, pricing, promotions, availability, or other website information.

4. Ingredients, Allergens and Food Information

Gladley’s confections are produced in a licensed commercial kitchen in Prince George’s County, Maryland.

Ingredient and allergen information is provided in accordance with applicable food-labeling requirements. Customers with food allergies or ingredient concerns are encouraged to contact us at support@gladleys.com before consuming a product if they have questions regarding its ingredients or allergen information.

5. Orders and Acceptance

When you submit an order, you are making an offer to purchase the products in your order.

Receipt of an order confirmation does not necessarily constitute our final acceptance of the order.

We reserve the right to refuse, cancel, or limit an order when reasonably necessary, including because of:

·         Product unavailability;

·         Incorrect pricing or product information;

·         Suspected fraud or unauthorized activity;

·         Payment or billing problems;

·         Shipping or delivery limitations;

·         Errors affecting the order; or

·         Circumstances that make fulfillment impractical or impossible.

If we cancel an order after payment has been collected, we will provide an appropriate refund for the canceled portion.

6. Prices and Payment

Prices are shown in U.S. dollars unless otherwise indicated.

Prices, promotions, discounts, and product availability may change without notice.

Applicable sales taxes, shipping charges, and other charges will be displayed during checkout when applicable.

You agree to provide current, complete, and accurate billing, payment, and contact information when placing an order.

Payments are processed through Shopify and applicable third-party payment providers. Your use of a particular payment method may also be subject to the terms and policies of the applicable payment provider.

7. Shipping and Delivery

Gladley’s currently ships within the United States.

Shipping options, estimated transit times, order-processing information, and special warm-weather shipping procedures are described on our Shipping Information page.

Because candy and confections can be affected by temperature, certain heat-sensitive products may require special shipping methods or schedules during warmer months.

Gladley’s currently uses warm-weather shipping procedures, including No-Melt Express™ for applicable heat-sensitive products during the warmer shipping season. Specific procedures, dates, available shipping methods, and other details are provided in our Shipping Information.

Delivery dates and transit times are estimates unless expressly guaranteed. Delays can occur because of weather, carrier operations, holidays, address problems, natural events, or circumstances outside Gladley’s reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

8. Perishable and Heat-Sensitive Products

Candy and other food products can be sensitive to heat, humidity, handling, and environmental conditions.

We take reasonable precautions when packaging and shipping heat-sensitive products, including using special warm-weather shipping procedures when appropriate.

Customers should retrieve delivered packages promptly, particularly during warm weather. Gladley’s cannot guarantee the condition of products that remain outdoors, in mailboxes, on porches, in vehicles, or in other hot environments for extended periods after delivery.

Please contact us promptly at support@gladleys.com if there is a problem with the condition of an order upon delivery.

9. Returns, Refunds and Order Problems

Because many Gladley’s products are food products, returns and refunds are subject to our Return Policy.

If your order arrives damaged, incorrect, defective, or otherwise has a problem, please contact us promptly at support@gladleys.com so that we can review the situation and determine an appropriate resolution.

Our current Return Policy is incorporated into these Terms by reference.

10. Gifts and Corporate Orders

Gladley’s may offer products intended for gifts, business gifts, corporate orders, or delivery to third-party recipients.

When placing an order for another person, you are responsible for providing accurate recipient and delivery information.

If you provide personal information concerning another person, such as a gift recipient’s name, address, or telephone number, you represent that you have an appropriate reason or authorization to provide that information for purposes of fulfilling the order.

For large, customized, or corporate orders, additional terms, lead times, payment arrangements, or shipping requirements may apply.

11. Promotional Offers and Discount Codes

Promotions, discounts, coupon codes, and special offers may be subject to additional terms.

Unless otherwise stated, promotional offers:

·         Have no cash value;

·         May not be combined with other offers;

·         May be limited to particular products, customers, quantities, or time periods; and

·         May be modified or discontinued where permitted by law.

We reserve the right to refuse or cancel the improper or unauthorized use of promotional offers.

12. Email Communications

If you voluntarily subscribe to Gladley’s email marketing, we may send you news, product announcements, seasonal information, special offers, and other promotional communications.

Marketing consent is voluntary and is not required to make a purchase.

You can unsubscribe from promotional email by using the unsubscribe link included in our marketing messages.

Unsubscribing from marketing does not prevent us from sending transactional or service communications related to an order, account, customer-service request, or other transaction.

13. SMS/Text Messaging Terms

Gladley’s may offer an optional SMS/text-message marketing program.

By voluntarily providing your mobile telephone number through an SMS marketing signup and affirmatively choosing to receive marketing text messages, you consent to receive recurring marketing and promotional text messages from Gladley’s Candy Kitchen, including news, product announcements, seasonal information, special offers, and updates.

Consent to receive marketing text messages is not a condition of purchasing any goods or services.

Message Frequency

Message frequency may vary depending upon promotions, seasons, product announcements, and other Gladley’s communications.

Message and Data Rates

Message and data rates may apply depending upon your mobile carrier and wireless service plan.

Gladley’s is not responsible for charges imposed by your mobile carrier.

Opting Out

You may opt out of Gladley’s marketing text messages at any time by replying STOP to a marketing text message.

After opting out, you may receive a confirmation message indicating that your unsubscribe request has been processed.

For assistance with Gladley’s text messages, you may reply HELP where supported or contact us at support@gladleys.com.

Mobile Number Changes

If you change, transfer, deactivate, or relinquish a mobile telephone number that you previously used to subscribe to Gladley’s SMS marketing, you should unsubscribe before discontinuing use of that number or contact us so that we can update our records.

Carriers

Mobile carriers are not responsible for delayed or undelivered messages.

Delivery of text messages may be affected by your wireless carrier, device, network availability, and other circumstances outside our control.

SMS Service Providers

Gladley’s uses Shopify and Shopify Messaging to help operate our SMS marketing program. Information about how personal information associated with SMS marketing is handled is provided in our Privacy Policy.

14. Customer Accounts

Certain features of our website may allow or encourage you to use a customer account.

You are responsible for maintaining the security of your account credentials and for activity occurring through your account.

Please contact us if you believe your account has been accessed or used without authorization.

We reserve the right to suspend or terminate accounts when reasonably necessary to protect customers, Gladley’s, Shopify, or others.

Our website is powered by Shopify and may use or link to third-party services, including payment providers, shipping carriers, social-media platforms, and other service providers.

Third-party websites and services are governed by their own terms and policies.

Gladley’s is not responsible for the content, availability, privacy practices, security, or operation of independent third-party websites or services.

GLADLEY’S® is a federally registered trademark used in connection with Gladley’s candy products.

The Gladley’s website and its content—including text, product names, photographs, illustrations, graphics, logos, designs, packaging imagery, and other materials—may be protected by copyright, trademark, and other intellectual-property laws.

Except as permitted by law or expressly authorized by Gladley’s, you may not reproduce, distribute, modify, publish, commercially exploit, or create derivative works from Gladley’s website content without permission.

Nothing in these Terms grants you ownership of Gladley’s intellectual property.

17. Reviews, Comments and Customer Submissions

If you voluntarily submit a review, comment, photograph, suggestion, feedback, or other content to Gladley’s, you represent that you have the right to provide that content.

You may not submit content that is unlawful, fraudulent, defamatory, threatening, infringing, malicious, obscene, or otherwise inappropriate.

To the extent permitted by applicable law, you grant Gladley’s permission to use content voluntarily submitted for publication or promotional purposes in connection with our business, subject to any applicable privacy rights and any specific agreement between you and Gladley’s.
